ILD brings litigation cases demanding accountability and due process for immigrants and challenging the conditions of immigration detention. ILD currently serves as class counsel in impact litigation cases focused on protecting the right of detained immigrants seeking protection from harm in their home countries to have a bond hearing or the right of families to have transparent information on the process for posting bond to secure their loved one’s release from detention. ILD also continues to work on individual habeas cases for detained individuals subject to prolonged detention.

ILD is currently representing dozens of families subjected to brutal family separation at the border. In addition to representation in their asylum cases, ILD represents them in lawsuits demanding relief pursuant to the Federal Tort Claims Act. Our attorneys regularly file novel lawsuits pursuant to the Freedom of Information Act (FOIA) to demand more transparency from the immigration court and agencies and, along with national partner organizations, ILD is the counsel of record on several FOIA lawsuits that demand transparency as to how immigration bonds are being processed, delays in the immigration courts releasing client files and policies relating to how asylum seekers continue to be denied due process at the border. We are also working on amicus efforts in several national cases demanding that immigration judges better take into account the mental health status of detained immigrants and others asking the courts to examine how “particularly serious crime” determinations are made in the immigration context.
